SUMMARY NOTICE OF PROPOSED CLASS ACTION SETTLEMENT

If you received an electronically printed receipt from Beggars Pizza in Richton Park, Illinois after December 4, 2006 that displays more than the last five digits of your credit or debit card number, or after June 3, 2008 that displays the expiration date of your credit or debit card:

PLEASE READ THIS NOTICE. IT DESCRIBES YOUR RIGHTS WITH RESPECT TO THE SETTLEMENT OF A LAWSUIT.

Tammy Goods filed a lawsuit against Beggars Pizza claiming that it violated the Fair Credit Reporting Act by issuing electronically printed receipts that display more than the last five digits of a customer’s credit or debit card number or the card’s expiration date. Ms. Goods brought this claim on behalf of herself and all others who received such a receipt from Beggars Pizza (“class members”). Beggars Pizza denies that it violated the law.

Beggars Pizza and Ms. Goods both believe they would win this lawsuit if it went to trial, but they have agreed to settle the case instead. Under the settlement, all class members are entitled to receive $12.00 worth of coupons that are redeemable at Beggars Pizza in Richton Park, Illinois.

If you are a class member, you can: (1) participate in the settlement; (2) exclude yourself from the settlement; (3) object to the settlement; or (4) enter an appearance in the lawsuit, either by yourself or though a lawyer. To exercise any of these options, you must take certain actions immediately.

To participate in the settlement, you must submit a claim form, which you can obtain by clicking here or by requesting one from class counsel, Thomas E. Soule of Edelman Combs Latturner & Goodwin LLC, by mail (120 South LaSalle Street, 18th Floor, Chicago, Illinois 60603), telephone ((312) 739-4200), or email (info@edcombs.com - click here). You must completely fill out the claim form, which is subject to verification, and affirm under penalty of perjury that you are a class member who is entitled to take part in the settlement. Claim forms must be mailed to the address listed on the form and postmarked no later than November 16, 2009. Each class member may submit only one claim form.

If you want to be excluded from the settlement, object to the settlement or enter an appearance in the lawsuit, you can obtain the instructions for doing so from class counsel, whose address, telephone number and email are set forth above, and must comply with the instructions on or before November 16, 2009.

If you do nothing, you cannot participate in the settlement or sue Beggars Pizza on your own for giving you an electronically printed receipt that displays more than the last five digits of your credit or debit card number or the card’s expiration date.

A hearing on the fairness of the settlement is set for December 9, 2009 at 10:00 a.m. in Room 1219 of the Dirksen Federal Courthouse, 219 South Dearborn Street, Chicago, Illinois. You may attend the hearing but are not required to do so to participate in the settlement.
